Evermark Trading LLC t/a Evermark Headstones

1. Introduction

These Terms & Conditions govern your use of our website and the purchase of products from Evermark Trading LLC t/a Evermark Headstones (“Evermark Headstones,” “we,” “us,” or “our”). By placing an order with us, you agree to be bound by these Terms.

2. Cemetery Regulations

It is the customer’s responsibility to confirm all measurements, materials, colours, styles, inscriptions, foundation requirements, installation requirements, and any other specifications required by the cemetery.
We do not accept liability for products rejected by a cemetery due to incorrect information provided by the customer.

3. Product Approval & Proofing

Before production begins, we will provide a digital design proof of your memorial for review. It is the customer’s responsibility to carefully check all details including spelling, dates, design, layout, font style, and dimensions.
Approval must be given in writing (email confirmation is sufficient) before production proceeds.

4. Cancellations & Refunds

Once the customer has approved the design proof, production will begin. At this stage, no cancellations, changes, or refunds are permitted.
Bespoke memorials are custom-made products produced to your specifications and are therefore exempt from standard consumer cancellation rights.

5. Production & Delivery

• Production times vary depending on the product and engraving requirements. Estimated delivery timelines will be provided at the time of purchase.
• We include free shipping to the lower 48 United States.
• Alaska & Hawaii incur additional shipping costs. Customers will be notified of these charges after ordering and prior to dispatch.
• Delivery delays caused by carriers, customs, weather, or other external factors are outside our control.

6. Installation

Unless installation services are explicitly included in your order, delivery is curbside only.
The customer is responsible for arranging installation with a qualified memorial installer where required.

7. Natural Stone Disclaimer

Granite and other natural stones may contain variations in colour, veining, grain pattern, and texture. These natural characteristics are not considered defects and are part of the uniqueness of each memorial.

8. Errors or Defects

If your memorial arrives damaged or with an error caused by Evermark Headstones, we will repair or replace the product at no additional cost.
Claims must be submitted within 48 hours of delivery with photographic evidence.

9. Pricing & Payment

All prices are listed in USD unless otherwise specified. Full payment is required at the time of ordering unless alternative arrangements have been agreed in writing.

10. Intellectual Property

All content, imagery, branding, and designs displayed on our website remain the property of Evermark Headstones and may not be reproduced without permission.

11. Limitation of Liability

We are not responsible for any direct or indirect loss resulting from:
• Cemetery refusal due to incorrect customer information
• Incorrect installation by third parties
• Delays outside our control
Maximum liability is limited to the purchase price of the product supplied.

12. Privacy Policy

Customer information is handled in accordance with our Privacy Policy. We do not share personal information with third parties beyond what is necessary to fulfil your order.

13. Governing Law

These Terms are governed by the laws of the State where Evermark Trading LLC is registered. Any disputes shall be resolved in the applicable state or federal courts.

14. Amendments

We reserve the right to update or modify these Terms & Conditions at any time. Continued use of our site constitutes acceptance of any changes.
